Course Cancellation Policy

1. Purpose

This policy establishes procedures applicable when 1Above Academy, LLC cancels, reschedules, suspends, or is otherwise unable to deliver an educational course.

2. Provider Cancellation of Scheduled Courses

The Provider reserves the right to cancel or reschedule a classroom, webinar, Online Instructor-Led, or other scheduled course when reasonably necessary because of:

  • Insufficient enrollment;
  • Instructor illness or unavailability;
  • Technology or system failure;
  • Severe weather or emergency conditions;
  • Regulatory or NMLS requirements;
  • Course approval or availability issues; or
  • Other circumstances that materially impair the Provider’s ability to properly deliver the course.

3. Notice

When practicable, affected students will be notified promptly using the email address, telephone number, or other contact information supplied during registration.

The Provider will make reasonable efforts to provide notice as soon as the need for cancellation or rescheduling becomes known.

4. Student Options Following Provider Cancellation

If the Provider cancels a course before completion, affected students will ordinarily be offered one or more of the following options:

  1. Transfer to another available offering of the same course;
  2. Transfer to another eligible course of equivalent value;
  3. Receive account credit for a future course; or
  4. Receive a full refund of the amount paid for the cancelled course.

If no reasonable substitute or rescheduled offering is available or acceptable to the student, the student may request a full refund.

5. Online Self-Study Course Interruptions

Temporary interruptions caused by routine maintenance or short-duration technical issues will not ordinarily constitute course cancellation.

If a material technical failure attributable to the Provider prevents students from accessing or completing an online course for an unreasonable period, the Provider will take reasonable measures to restore access, extend the applicable completion period, transfer enrollment, or provide a refund as appropriate.

6. Loss or Suspension of Course Approval

The Provider will not represent or offer a course as NMLS approved unless the course is currently eligible to be offered as such.

If an event affecting NMLS approval prevents the Provider from delivering a purchased course for applicable NMLS credit, the Provider will notify affected students and provide an appropriate transfer, rescheduling opportunity, credit, or refund.

7. Student Cancellation

Student-requested cancellations are governed by the Provider’s Refund Policy.

8. Force Majeure

The Provider will not be responsible for delays or interruptions resulting from circumstances outside its reasonable control, including natural disasters, governmental actions, telecommunications outages, widespread internet failures, civil emergencies, or similar events.

The Provider will nevertheless make reasonable efforts to provide affected students with an alternative means or opportunity to complete the applicable educational requirement.
